Enio Terms of Service

By using the Enio website, or any other services ("Service") operated by Enio Energy Management Ltd. you agree to be bound by the following terms and conditions of use ("Terms of Use").

Enio Energy Management Ltd. reserve the right to update or change the Terms of Use from time to time without notice. Any new features that extend or enhance the Service, including the release of new tools and resources, shall be subject to the Terms of Use. Continued use of the Service after any of these changes shall constitute your consent to these changes. Violation of any of the terms below will result in the termination of your Account.

Service Description

Enio enables its users to store, share and discover realtime sensor, energy and environment data ("User Data") from objects, devices and buildings around the world. Enio does not select or screen User Data and does not verify its accuracy; this licence does not imply or create any liability on the part of Enio Energy Management Ltd. for User Data provided by other users.

ALL SERVICES, SOFTWARE AND INFORMATION ARE PROVIDED "AS-IS" AND "AS AVAILABLE". Enio Energy Management LTD. EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF THE RIGHTS OF THIRD PARTIES.

Account Terms

  1. You must be 13 years or older to use this Service.
  2. You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
  3. Your login may be used by only one person - a single login shared by multiple people is not permitted.
  4. You are responsible for maintaining the security of your account and password. Enio Energy Management Ltd. cannot and will not be be liable for any loss or damage arising from your failure to comply with this security obligation.
  5. You are responsible for all User Data posted and activity that occurs within your Account.
  6. One person or legal entity may not maintain more than one free account.
  7. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

API Terms

You may access your User Data via an API (Application Programming Interface). Any use of the API, including use of the API through a third party product that accesses the Service, is bound by the terms of this agreement, plus the following specific terms:

  1. You expressly understand and agree that Enio Energy Management Ltd. shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Enio Energy Management Ltd has been advised of the possibility of such damages), resulting from your use of the API or third party products that access data via the API.
  2. Abuse or use of the API outwith the limits specified for your Account may result in the temporary or permanent suspension of your account's access to the API. Enio Energy Management Ltd. in its sole discretion, will determine abuse or excessive usage of the API. Enio Energy Management Ltd. will make a reasonable attempt to notify the account owner, via the email address we have on record for you, prior to suspension or termination.
  3. Enio Energy Management Ltd. reserves the right at any time to modify or discontinue, temporarily or permanently, your access to the API (or any part thereof), with or without notice.
  4. You are responsible for maintaining the security of any API keys used to access your account via the API. Enio Energy Management Ltd. cannot and will not be liable for any loss or damage rising from your failure to comply with this security obligation.

Payment, Refunds, Upgrading and Downgrading Terms

  1. A valid credit or debit card or Paypal account is required for paying accounts ("Premium"). Free accounts are not required to provide these details.
  2. If you initially sign up for a Premium account and you don't cancel that account with 14 days, you will be billed monthly starting on the 14th day after your account was created. If you cancel your account prior to the processing of your first invoice on the 14th day, you will not be charged.
  3. If you initially signed up for a Free account, then upgrading to a Premium account will end your trial period, and you will be billed for the first month immediately.
  4. The Service is billed in advance on either a monthly or an annual basis, and is non-refundable. There will be no refunds or credits for partial months of service.
  5. If you upgrade or downgrade your account, then your credit/debit card or Paypal account will be automatically charged the new rate on your new billing cycle.
  6. Downgrading your account may cause the loss of User Data, features and capacity of your account. Enio Energy Management Ltd. do not accept any liability for such loss.

Cancellation/Termination of Account

  1. You are solely responsible for properly cancelling your Account. Cancellation requests can be made by email to contact@enio.co.uk.
  2. All of your User Data will be immediately deleted from the Service upon cancellation. This information cannot be recovered once your Account has been cancelled.
  3. If you cancel your Account before the end of your billing cycle, your account will be deleted immediately and you will not be charged again.
  4. Enio Energy Management Ltd. in its sole discretion, has the right to suspend or terminate your Account and refuse any and all current or future use of the Service, or any other service operated by Enio Energy Management Ltd. for any reason, and at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all User Data in your Account. Enio Energy Management Ltd. reserves the right to refuse service to anyone for any reason at any time.

Modification to the Service or Prices

  1. Enio Energy Management Ltd. reserve the right to modify or discontinue, temporarily or permanently the Service, its terms, or any part thereof, with or without notice.
  2. Prices of all Services, including but not limited to monthly subscription plan fees are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes on the Enio website (http://www.enio.co.uk). In addition we will attempt to notify you at the primary email address we hold on record for you.
  3. Enio Energy Management Ltd. shall not be liable to you or to any third party for any modification, price change, suspension or termination of the Service.
